1. Will I have to pay court costs even if I don’t go to court?

Yes, within the $90.00 labeled as court costs are State Mandated fees that must be collected on every citation, regardless of appearing in court or simply paying the fine.

2. Does your court offer community service if I don’t have the money to pay my fine?

At this time we currently are not offering community service, but that does not mean that will not be a possibility at a later time.

3. How soon will I get my Driver’s License reinstated after I pay my fines?

Once all of your court requirements are met the appropriate paperwork will be submitted to the State of Kansas. That will typically take 7-10 business day from the time of receipt to process the requests.

4. What Plea Options Are Available?

Guilty: You admit to the act you are charged with, and admit that the act is unlawful, and that you
have no defense for the action you committed.

Not Guilty: You deny that you committed the unlawful act you were charged with. At
that time it becomes the responsibility of the city to prove your guilt in trial.
Everyone is presumed innocent until proven guilty beyond a reasonable doubt.

No Contest: You have the option to plea no contest to the City’s charge. Upon a plea of no
contest, the Judge will enter a finding of guilty and order a fine, jail time or other
sentence. A plea of no contest is not an admission of guilt or fault and cannot be
used against you in a civil suit for damages.

5. How may I appeal my verdict?

Anyone found guilty in the Andover Municipal Court has a right to appeal the conviction to the Butler County District Court, El Dorado, Kansas.

To appeal, the defendant must post an appearance bond in an amount determined by the Municipal Judge, file proper notice with a municipal court clerk, serve notice on the City Prosecutor and appear in Butler County District Court, El Dorado, Kansas.

These requirements are subject to a specific time limit which must be complied with by the defendant.

6. How do I pay for a fine or fee?

You can pay your fine or fee in person by going to the Municipal Court located in City Hall at 1609 E Central during business hours or you may pay online by clicking the following link: www.andoverks.com/onlinepayments

You will need to have your citation number.  Payment types accepted are: cash, check, debit/credit card.  Please note, if you use a debit/credit card there will be a processing fee of 3%

7. Payment Methods?

Cash, check, money order, cashier check and debit/credit
cards.  (Please note if using a credit or
debit card a 3% convenience charge will be added for each transaction).

8. What is 'Arraignment'?

When a complaint or traffic citation is issued, the person charged is given an arraignment date to appear in court. That person, known, as the “defendant,” has the right to have the complaint or citation read to him/her prior to entering a plea. The defendant may enter one of three pleas: guilty, no contest, or not guilty. The Judge will not hear evidence about the case at an arraignment if the defendant enters a not guilty plea. The defendant will have the opportunity to present evidence at the trial.

9. Is there a way to pay for a citation without appearing in court?

Some citations may be paid without appearing in Court.  You must, however, pay the citation on or
before your court date.   Please refer to
the back of your citation regarding if your citation is a payable
citation.  If the citation is not paid on
or before your court date and you do not appear in court, a warrant for your
arrest may be issued.

If your citation states “COURT” in the Total Due portion of your citation, this means
that it is not a payable citation and you must appear in court

10. What should I do if I have a warrant?

You may post your bond anytime at the Andover Police Department and will be given a court date to appear before the Judge. The bond may be paid with cash, or through a surety bondsman. You should appear at the Police Department with identification.

11. Is there a drop box for payments?

Yes.  It is located at the front doors of City Hall, (where Municipal Court is housed) at 1609 E Central

12. What is the Court Attire and Etiquette?

No one may wear clothing that is offensive, obscene, vulgar, racist or sexist, or contains gang related language or graphics.

No hats, unless for religious purposes.

No sunglasses unless under Doctor's care.

Shoes are required.

Electronic devices must be on silent in the courtroom.

Food and Drinking are not allowed in the courtroom.
